Claybrooks v. State
Maryland Court of Appeals
374 A.2d 365 (1977)

- Written by Sean Carroll, JD
Facts
William Claybrooks (defendant) was found guilty of multiple crimes in county court and sentenced to prison terms totaling 28 years. Claybrooks had also been found guilty and sentenced to 23 years in federal district court for the same conduct. The county court ruled that 13 of Claybrooks’s 28 years would be served consecutively, after his sentence from federal court concluded. Claybrooks appealed, arguing that serving the sentences consecutively for the same conduct violated the constitutional prohibition against double jeopardy.
