Facts
Junior groundwater appropriators at a river (Groundwater Users) pumped groundwater from the river, and the groundwater pumping caused a gradual loss of water discharge from the springs. The State Director of Water Resources (DWR) (defendant) ordered the Groundwater Users to reduce their water withdrawals. The DWR found that the Groundwater Users caused material injury to the appropriators of the spring water, Clear Springs Foods, Inc. (Spring Users) (plaintiff). The Spring Users owned senior water rights. Both the Groundwater Users and the Spring Users appealed the DWR’s final curtailment order requiring the Groundwater Users to reduce their water withdrawals. The Spring Users appealed the curtailment order, arguing that the DWR’s ruling did not sufficiently reduce the groundwater pumping.
