Facts
Morgan Van Breda (plaintiff) was injured while vacationing in Cuba. Club Resorts Ltd. (defendant) managed the hotels where the accident occurred. Van Breda sued Club Resorts in an Ontario court. Club Resorts motioned to dismiss on the grounds that the Ontario court lacked jurisdiction and that a Cuban court was a more appropriate forum. The Ontario court denied the motion. Club Resorts appealed.
