Facts
Coach, Inc. (plaintiff), a seller of luxury fashion accessories, brought a trademark-counterfeiting action in the United States District Court for the District of New Jersey against Ocean Point Gifts (OPG) and ten John Doe defendants (defendants). Coach alleged that OPG sold counterfeit Coach merchandise from a store located on the Atlantic City, New Jersey Boardwalk. Coach presented information obtained from its private investigator (Investigator Smith) indicating that, for example, OPG sold a $12.99 imitation of a $200 Coach wallet. Investigator Smith further reported that OPG displayed 25 counterfeit bags priced at $24.99 each, 60 handbags priced from $39.00 to $59.00 each, and five scarf and hat matching sets with an unstated price. OPG failed to answer Coach’s complaint. Coach moved for a default judgment against OPG and requested $2 million in damages.
