Facts
Following the U.S. Supreme Court’s decision in Massachusetts v. EPA, 549 U.S. 497 (2007), the Environmental Protection Agency (EPA) (defendant) promulgated a series of rules targeting greenhouse gases, including an “Endangerment Finding,” a “Tailpipe Rule,” and “Timing and Tailoring Rules.” The Coalition for Responsible Regulation, several states, and industry groups (plaintiffs) filed petitions in federal court challenging the rules claiming they were based on improper constructions of the Clean Air Act (CAA).
