Facts
Salinas (plaintiff) owned a tract of land (Share 13) and its minerals. Coastal Oil & Gas Corp. (Coastal) (defendant) leased the minerals from Salinas for a royalty. Coastal also owned the tract of land next to Salinas’s tract (Share 12). Coastal dug a well on Share 12 and began hydraulic fracturing (fracking), which had the effect of draining gas from Salinas’s Share 13. Salinas brought suit for trespass, seeking damages for the gas that Coastal’s fracking drained from Salinas’s Share 13. The trial court found in Salinas’s favor and the court of appeals affirmed. Coastal appealed.
