Facts
After an economic downturn, the California Resources Agency (defendant) entered into a memorandum of understanding with a private nonprofit organization to facilitate the Marine Life Protection Act and protect state waters. The understanding was to help provide the state agency with the funds to comply with the act. The Coastside Fishing Club (plaintiff) sued, arguing that the agreement was unlawful and impermissibly delegated legislative power to the executive branch and private parties. The court ruled in the agency’s favor, and the club appealed.
