Facts
Cobaugh (plaintiff) was playing golf and on the ninth tee there was a new car and sign put up by Klick-Lewis (defendant), a car dealership, offering the car to anyone who got a hole-in-one on that hole. Cobaugh got a hole-in-one, but Klick-Lewis refused to give him the car because they had put the sign up for a tournament two days prior, but had neglected to take it down. The sign did not indicate the promotion was only good for the other tournament. Cobaugh sued to compel delivery of the car and both parties moved for summary judgment. The trial court granted Cobaugh summary judgment. Klick-Lewis appealed.
