Facts
Marguerite G. Coggin (plaintiff) leased an apartment from Starke Brothers Realty Co., Inc. (Starke Brothers) (defendant). The back stairs leading to the apartment were steep and narrow and did not have a handrail. The back stairs were part of the common area of the apartment building, and they could be used by the other tenants. Coggin fell on the stairs one day, sustaining significant injuries. Coggin could not say what specifically caused her to fall. Coggin sued Starke Brothers, alleging that the back stairs were a dangerous condition of which the Starke Brothers should have been aware and should have remedied. The trial court granted summary judgment in favor of Starke Brothers, and Coggin appealed.
