Facts
Goodwin & Story (defendants) owned stagecoaches. When Cole (plaintiff) traveled on Goodwin & Story’s stagecoach, the stagecoach lost his trunk. Goodwin & Story finally delivered the trunk 11 months later, but money and other items were missing from the luggage. A jury found in favor of Cole and awarded him $101.96 damages. Goodwin & Story appealed.
