Facts
On July 15, 1994, 16-year-old Collins (defendant) was arrested along with two other people for residential burglary. At the time of his arrest, Collins had a pistol holder and a pair of gloves in his possession, and the other two men had diamonds and firearms in their possession. On August 4, 1994, the trial court held a transfer hearing to determine whether Collins should be tried in the circuit court as an adult. Collins’s probation officer testified at the hearing that Collins had numerous prior court referrals for multiple offenses, that Collins had not been compliant with the terms of his previously imposed probation, and that he had not taken advantage of counseling services that were offered to probationers. Following the hearing, the trial court found that Collins should be transferred to circuit court for criminal prosecution. Collins then filed an interlocutory appeal.
