Facts
Victor Reichman (defendant), the district attorney of Colorado’s sixth judicial district, formed a task force with other law-enforcement members to investigate and prosecute drug crimes. During the investigation, the covert identity of a task-force undercover officer was compromised. In order to rehabilitate the officer’s covert identity, Reichman and the task force staged the arrest of the undercover officer and charged the officer with firearm and drug charges. As part of the fictitious prosecution, a false criminal complaint was filed, and false statements were submitted to the court without the judge’s knowledge. The special assistant disciplinary counsel, on behalf of the State of Colorado (plaintiff) filed a complaint charging Reichman with violations of disciplinary rules prohibiting acts of dishonesty, fraud, deceit, or misrepresentation. A hearing panel ruled against Reichman and recommended that he be publicly censured for his actions.
