Facts
Cecil Combs (plaintiff) was standing on the steps of a trolley operated by the Los Angeles Railway Corporation (LA Railway) (defendant) because the interior of the trolley was full. It was impossible for Combs to reach the inside of the trolley. While Combs was riding on the steps, the trolley crashed into a car. Combs suffered numerous injuries. Combs brought a negligence suit against LA Railway. The jury found in favor of Combs. LA Railway appealed, arguing that the jury should have found Combs to be contributorily negligent because of a local law that made it illegal to ride on the steps of a trolley.
