Facts
In Greece, businesses other than pharmacies were prohibited from selling baby formula—processed milk for infants—unless the municipality where the business was located did not have a pharmacy (the law). Greece had no domestic producers of formula, and all formula sold in Greece was imported from other countries. The European Commission brought an enforcement action against Greece for violation of the prohibition on restrictions on the quantity of imports from other European Union (EU) member states under the Treaty of Rome.
