Facts
Superior Propane Inc. (Superior) (defendant) wanted to merge with another propane exporter. Economic estimates concluded that the merger would raise propane prices by 8 percent, with some price increases affecting foreign customers. The Commissioner of Competition (commissioner) (plaintiff) commenced an action in Canada’s Competition Tribunal, objecting to the horizontal merger on the basis that any efficiencies the merger created would not outweigh the harm resulting from the increased price of propane.
