Facts
CBM Kabushiki Kaisha (Kaisha) (plaintiff) filed an application to register the mark “CBM” for a number of possible products. Commodore Electronics Ltd. (Commodore) (defendant) opposed Kaisha’s application before the Trademark Trial and Appeal Board (TTAB), claiming that Kaisha had no bona fide intent to use the mark in commercial trade or commerce. Commodore sought an amendment to its opposition, and Kaisha filed for summary judgment in the event that TTAB granted Commodore’s amendment.
