Facts
Iafrate (defendant) was arrested on the evening of September 29, 1985, after a police officer attempted to give him a citation for loitering earlier in the day. Iafrate turned 18 years old on September 30, 1985, the day after his arrest. Prior to trial, Iafrate filed a motion to transfer his case to juvenile court. The court denied Iafrate’s transfer motion. Iafrate was tried as an adult and convicted by a jury of simple assault. Iafrate later appealed the denial of his motion to transfer his case to juvenile court.
