Commonwealth v. Camerano
Massachusetts Appeals Court
677 N.E.2d 678 (1997)
- Written by Kaitlin Pomeroy-Murphy, JD
Facts
Antonio Camerano (defendant) rented a piece of land on his property to Robert Howell. Howell placed his house trailer on the land and built a garden enclosure. The enclosure was very large, had no windows, and was padlocked. Members of the state police and the National Guard counterdrug-operations team spotted the enclosure while flying overhead and subsequently obtained a warrant to search Camerano’s house, land, and the garden enclosure. When police officers searched the enclosure, they found marijuana plants and bagged marijuana. Nothing related to drug use or distribution was found in Camerano’s home. Camerano was charged with conspiracy to possess marijuana with the intent to distribute and was convicted by jury. Camerano appealed, arguing that it was error for the trial court to deny his motion for a required finding of not guilty.
