Facts
Patrick Durham (defendant) filed a discovery motion requesting names of witnesses and an opportunity to inspect documentary and physical evidence that the commonwealth (plaintiff) intended to introduce against him at trial. The commonwealth filed a reciprocal discovery motion requesting written or recorded statements of any witness, including potential commonwealth witnesses, whom Durham intended to introduce at trial for any purpose, including impeachment. The trial court granted the commonwealth’s motion. Durham challenged this order on appeal.
