Facts
A tavern was robbed, and during the robbery, a patron’s credit card was stolen. Six days later, the credit card was presented at a gas station by men who then robbed the gas station. Foose (defendant) was charged with the tavern robbery. At trial, the prosecution (plaintiff) offered testimony of the gas-station clerk. The clerk identified Foose as the man who presented the stolen credit card and robbed the gas station. Foose was convicted, and he appealed, arguing that the evidence should not have been admitted.
