Facts
Harry Leno operated a hypodermic needle-exchange program that gave clean needles to drug addicts in an effort to reduce the transmission of AIDS. Massachusetts had enacted a law that prohibited the distribution of hypodermic needles without a prescription, and the needle exchange was in violation of this statute. Leno was charged and during the trial requested that the judge instruct the jury on the defense of necessity. The judge denied the request, and Leno was convicted. Leno appealed.
