Facts
Tyler Mangel (defendant) was charged with assault. The prosecution (plaintiff) filed a motion in limine to introduce Facebook posts and chats allegedly written by Mangel. The posts were purportedly about the fight that had resulted in the assault charge. The posts came from a Facebook account in the name of “Tyler Mangel.” The account listed Mangel’s hometown and high school and contained a few pictures of Mangel. The prosecution did not provide any additional evidence connecting the account to Mangel. The trial court denied the motion and excluded the Facebook posts. The prosecution appealed.
