Facts
Javan McBurrows (defendant) was charged with murder. McBurrows’s wife saw McBurrows dispose of a mason’s level, the alleged murder weapon. McBurrows filed a motion to exclude his wife’s testimony on the matter under the marital-communications privilege. The trial court granted the motion. The Commonwealth of Pennsylvania (plaintiff) appealed, arguing that the privilege did not apply.
