Facts
Mr. McLaughlin (defendant) struck three people walking in the road with his car. He had seen the people in the road, but did not have enough time to avoid hitting them. After striking the victims, McLaughlin returned to the scene of the accident and attempted to help them. Two of the victims died, and the third was seriously injured. The jury found McLaughlin guilty of second degree murder, and he appealed.
