Facts
The commonwealth (plaintiff) charged Dr. Stephen Scher (defendant) with the murder of Martin Dillon 20 years after Dillon’s death from a gunshot wound to his chest. A jury convicted Scher. Scher appealed, challenging the 20-year delay in filing charges as a violation of due process. The intermediate appellate court reversed. The commonwealth appealed.
