Commonwealth v. Serge
Pennsylvania Superior Court
837 A.2d 1255 (2003)

- Written by Darius Dehghan, JD
Facts
Michael Serge (defendant) was charged with first-degree murder for fatally shooting his wife. At the trial, the commonwealth (plaintiff) presented testimony from expert witnesses Dr. Gary Ross and Trooper Bradley Beach. Ross and Beach offered their respective opinions on how the shooting occurred. A computer-generated animation was used to illustrate their opinions. Further, each expert witness testified that the animation fairly and accurately depicted his opinion. The trial-court judge found that the computer-generated animation was authenticated. Because the animation satisfied the other requirements for admissibility, the trial-court judge admitted the animation. Subsequently, the jury convicted Serge. Serge appealed.
