Facts
Part-time public defenders George and Walter Stenhach (defendants) were appointed to represent Richard Buchanan who was accused of first-degree murder. At Buchanan’s direction, the Stenhachs’ investigator retrieved the stock of a rifle that was used in the killing but did not inform the prosecution they had it until Buchanan’s trial. After Buchanan was found guilty of third-degree murder, the Stenhachs were charged with hindering prosecution, tampering with physical evidence, criminal conspiracy, and criminal solicitation. A jury found both Stenhachs guilty of hindering prosecution and tampering with evidence, found George guilty of criminal solicitation and Walter guilty of conspiracy. The Stenhachs appealed their convictions.
