Facts
The Commonwealth of Massachusetts (plaintiff) indicted Thomas Yourawski and Dominic Rizzuto (defendants) with receiving, purchasing, and aiding in the concealment of intellectual property contained on two video cassette tapes. The intellectual property was the copyrighted movie Star Wars. The indictments alleged that the intellectual property belonged to a film corporation, was valued at over $100, and was known to Yourawski and Rizzuto to be stolen. The video cassette tapes were not stolen. The trial court dismissed the indictments on the basis that they did not allege the crime of receiving stolen property. The state appealed.
