Facts
In 1982, Compagnie Europeenne des Petroles S.A. (CEP) (plaintiff), a company incorporated under French law and domiciled in France, approached Sensor Nederland B.V. (Sensor) (defendant), a company incorporated under Dutch law and domiciled in the Netherlands. CEP offered to buy 2,400 strings of geophones with spare parts from Sensor. Sensor agreed to this purchase, which included terms of delivery that listed the USSR. After discussing the order for several weeks, Sensor informed CEP that Sensor could not deliver the geophones. Sensor claimed that as a subsidiary of a US corporation, it had to respect the June 1982 US trade embargo enacted against the Soviet pipeline. CEP sued Sensor in the District Court in The Hague, the Netherlands, asking the district court to order Sensor to complete the purchase order.
