Facts
In Illinois, the state gave funds called per capita student tuition to school districts following a formula that multiplied a fixed amount per student in the district multiplied by the students’ average daily attendance. Comprehensive Community Solutions, Inc. (CCS) (plaintiff) sought to create a charter school and submitted a proposal to Rockford School District No. 205 (district) (defendant). At the time, the district was in such dire financial condition that its capacity to continue operating was in doubt. CCS’s proposal would require some of the district’s per capita-student-tuition money to be reallocated from district schools and operations to fund the charter school. The district denied CCS’s proposal, and the Illinois State Board of Education (board) upheld the district’s decision. CCS sought judicial review of the board’s decision. The trial court ruled to uphold the board’s decision, and the appellate court affirmed. CCS appealed to the Illinois Supreme Court.
