Facts
The City of West Palm Beach (city) (defendant) funded and maintained the Dreher Park Center (center), a facility that ran a wide variety of recreational and social programs for the city’s disabled population. The center was funded through the Special Populations section of the Department of Leisure Services (department). The department had a mission to provide comprehensive and quality recreation services to the city’s residents. Eventually, the city instituted budget cuts due to financial difficulties. The cuts led to a reduction in the department’s budget. A significant portion of the cuts came out of the Special Populations section, effectively shutting down all of the center’s programs. Parents and community members (plaintiffs) filed suit against the city, seeking injunctive relief and claiming that the budget reductions to the center’s programs constituted discrimination in violation of the Americans with Disabilities Act (ADA). As part of its preliminary-injunction analysis, the court decided whether the community would likely prevail on the merits of the ADA claim.
