Facts
Evelyn Conner (plaintiff) worked as a police dispatcher for the City of Forest Acres (defendant) for nine years. The city issued two employee handbooks to Conner. The more recent handbook, issued in 1993, contained a code of conduct and mandatory procedures for discipline. The handbook also contained several clauses characterizing Conner’s employment as at will. The city terminated Conner after she violated city policies numerous times. Conner disputed her termination at a hearing before the grievance committee. The committee voted to reinstate Conner, but the city council voted to uphold her termination. Conner brought an action for breach of contract against the city. The city moved for summary judgment, which the trial court granted. The appellate court reversed, finding that the employee handbook may have created a contract, which is a matter for the jury to decide. The city appealed to the South Carolina Supreme Court.
