Facts
Robert Conrad got into a car accident with the Heberts. Farmers Insurance Group insured the car Conrad was driving. The Heberts each sent a letter to April Bossley, an adjuster for Farmers. Each of the letters offered to settle the claims and stated, “Payment must be made to me on or before 5:00 p.m., July 5, 2006.” The letters clearly stated that the offers would expire if payment was not received by the deadline. Bossley responded, agreeing to the payment amount but asking the Heberts to fill out release forms prior to sending the checks. The Heberts did not respond to this, and no payment was made prior to the deadline. Conrad claimed that a valid settlement existed between the parties.
