Facts
Constancio (defendant) was charged with rape. At trial, his ex-wife testified, over his objection, that during their marriage he often suffered from erectile dysfunction. Constancio was convicted. He appealed on the grounds that sexual behavior during marriage should be covered under the spousal privilege preventing disclosure of confidential communications.
