Facts
The Tennessee Regulatory Authority (TRA) (defendant) approved rate increases for the Nashville Gas Company. TRA staff members who played no adversarial role in the case furnished ex parte advice to the agency heads. The TRA’s Consumer Advocate Division (CAD) (plaintiff) moved for discovery of these communications. The TRA denied the CAD’s motion for discovery. The CAD appealed.
