Facts
The Cosmetic, Toiletry and Fragrance Association, Inc., drafted a proposal for an ingredient review plan and asked to meet with the Food and Drug Administration (FDA) to get its advice and comments. The association and the FDA had several meetings regarding the proposal. Consumers Union of United States, Inc. (plaintiff) requested permission to participate in the meetings. The FDA denied permission on the grounds that these were private meetings initiated by the association. Consumers sued, arguing that it should be allowed to attend the meetings under the Federal Advisory Committee Act.
