Facts
Alecia Mason (plaintiff) brought claims for employment discrimination, wrongful termination, and infliction of emotional distress against Continental Airlines, Inc. (defendant). Under Continental Airlines’ employee handbook, there was an arbitration procedure that did not provide for discovery or legal counsel. The district court ordered Mason’s claims to be arbitrated, consistent with the handbook. Mason appealed, claiming that the handbook was unconscionable because it did not provide for legal counsel or discovery.
