Facts
Continuum Co., Inc. (plaintiff) sued Incepts, Inc. (defendant) for trade-secret appropriation and breach of contract. Continuum sought an injunction preventing Incepts from using certain software. The district court granted the injunction on the condition that Continuum pay a $200,000 bond. Nine months later, Incepts filed a motion to either increase the bond to $5 million or dissolve the injunction. The district court entered an order continuing the injunction upon Continuum increasing the bond to $2 million. Continuum appealed to the United States Court of Appeals for the Fifth Circuit for a stay of the district court’s order.
