Facts
John Coomer (plaintiff) was attending a Kansas City Royals (Royals) (defendant) baseball game when he was hit in the eye with a hotdog thrown by the team’s mascot. The mascot’s hotdog toss occurred at every Royals home game. Coomer sued the Royals. The trial court instructed the jury to determine whether being injured by the hotdog toss was a risk inherent in watching a Royals game. The jury found that it was and returned a verdict in favor of the Royals. Coomer appealed.
