Corbett v. Bison Boys, L.L.C.
United States District Court for the District of Idaho
2021 WL 780899 (2021)

- Written by Kate Luck, JD
Facts
David Corbett (plaintiff) entered into a contract with Bison Boys, L.L.C. (defendant) to market a reality-television show about the Bison Boys. The contract granted Corbett the exclusive right to market and promote the television show to third parties and gave Corbett the authority to negotiate a contract with a third party to create the show. The relationship between the parties deteriorated, and the Bison Boys sent Corbett a letter terminating the contract. Corbett filed a complaint against the Bison Boys for breach of contract, among other claims. Corbett asserted that he expended time and money promoting the show in accordance with his obligation under the contract and that he turned down other business opportunities in reliance on the contract. The Bison Boys filed a motion to dismiss, asserting that Corbett had not alleged that he suffered a compensable injury and, therefore, lacked standing to bring suit. The Bison Boys also argued that if Corbett was entitled to reliance damages, the Bison Boys were entitled to an offset for losses Corbett would have sustained had the contract been performed.
