In March 1967, while at the Jockey Turf Club (the club) (defendant), Kenneth Corbin (plaintiff) placed a $100 wager at 200-to-1 odds that the Boston Red Sox would win the American League pennant for that season. When the Red Sox won the pennant that fall, Corbin attempted to collect the $20,000 in winnings. The club refused to pay the winnings, claiming that the wager was taken by an employee who never actually recorded the bet and instead kept the money for himself. Corbin sought the assistance of the Nevada Gambling Control Board, but he was denied any relief. After receiving no assistance from the Nevada Gambling Control Board, Corbin filed a civil action in Nevada state district court, arguing that the district court should enforce the gambling debt. The district court refused to do so, holding that gambling debts were not enforceable in court under Nevada’s version of the statute of Queen Anne, despite the fact that the underlying gambling would not have been unlawful. Corbin appealed, arguing that the Queen Anne provision only applied against the proprietors of gambling establishments, such that the debt of gambling patrons could not be enforced in court, because the statute was intended to protect patrons.
