Facts
After filing a RICO suit against Rosewood Care Center, Inc. (Rosewood) (defendant), Corley (plaintiff) conducted voluntary interviews of non-party witnesses under oath and with a court reporter present. Rosewood, likening the interviews to depositions because of the oath and court reporter, filed a motion for a protective order requiring Corley to give Rosewood notice each time such an interview was conducted as though they were depositions. The district court, treating the interviews like depositions, granted the motion. Corley appealed.
