Facts
The defendants hired the plaintiff, a real estate broker, to sell their property. The parties’ agreement required the defendants to pay the plaintiff a 7-percent commission upon the sale of the property. The plaintiff found a prospective buyer who made an offer on the property. The defendants accepted the offer and signed a purchase agreement with the prospective buyer. Prior to closing, however, the buyer backed out of the deal because he was financially unable to pay the agreed upon sale price. Despite the property not selling, the plaintiff brought suit seeking payment of the 7-percent commission. The district court granted the defendants summary judgment. The plaintiff appealed.
