Facts
Charles Bonney managed an inn owned by Coconut Island Corporation (defendant). When Patricia Costos (plaintiff) checked in as a guest, Bonney escorted her to her room and gave her a room key. Late that night, Bonney used another key to enter Costos’s room and rape Costos. Costos pushed away her assailant. Bonney fled and had not yet been arrested when Costos filed a federal diversity suit against Coconut Island. The applicable statute was Maine’s version of § 219(2)(d) of the Restatement (Second) of Agency. The district court denied Coconut Island’s motion for a directed verdict. Coconut Island appealed to the First Circuit.
