Facts
Paula and Charles Cote were married, but a domestic dispute, the details of which are in question, caused irreparable harm to the relationship. Charles (plaintiff) then filed for divorce and on the same day Paula (defendant) filed a Petition for Protection from Domestic Violence. The trial court then barred Charles from entering the Cotes’ marital home. Charles brought this suit, claiming an unconstitutional taking of property. The trial court found that the court’s order was not a taking. Charles appealed.
