Facts
Lillie Counts (defendant) hired someone to kill her husband Robert Counts (plaintiff). The murder attempt failed, but Robert was left physically and mentally injured. A couple of months after the attack, Robert discovered Lillie’s role in the attack. She was put in jail. The couple divorced in 1977 and Robert brought suit against Lillie for his injuries shortly thereafter. Lillie pled interspousal immunity. The trial court held in favor of Lillie. Robert appealed.
