Facts

The Metropolitan Alliance of Police (MAP) petitioned the Illinois Labor Relations Board (board) (plaintiff) seeking certification as bargaining representative for deputy sheriffs working for the County of Du Page, Illinois (defendant). MAP filed a “majority interest petition” with valid union-authorization cards signed by a majority of the deputies in the proposed unit to start a streamlined Illinois statutory procedure allowing unions to obtain certifications without elections. The county objected, claiming the Illinois statute required two kinds of evidence showing majority support, making the board rule requiring only one kind invalid. The county also claimed entitlement to copies of MAP’s evidence. The board rejected those arguments and certified MAP as the unit’s exclusive bargaining representative. The county appealed. The appellate court vacated the board’s decision and remanded to the board, reasoning MAP had to submit additional majority-interest evidence and that the county could review MAP’s evidence if employees’ identities were redacted. The board and MAP appealed.
