Facts
Suffolk County (the county) (plaintiff) in New York sued First American Real Estate Solutions (First American) (defendant) for copyright infringement. Specifically, the county alleged that First American infringed on its copyrights with regard to its official tax maps because First American published and marketed the tax maps without the county’s permission following an open-records request. First American filed a motion to dismiss, asserting that the county failed to properly state a claim because the state’s open-records law prohibited the county from asserting a copyright on the maps. First American further argued that if the county was able to assert a copyright, it would unduly limit the public’s access to information that was otherwise permitted under the open-records law. The district court granted First American’s motion and dismissed the county’s complaint. The county appealed.
