Facts
The decedent, a nonresident of Kentucky, had executed a will in a foreign state that at the time it was executed was valid to pass title to real estate in Kentucky. Sometime thereafter, the decedent was divorced and under Kentucky law, the will was considered revoked. A Kentucky trial court nonetheless ordered probate of the foreign will to effect the transfer of both Kentucky personalty and realty, and an appeal was taken.
