Facts
Robinson’s Department Store (Robinson’s) was owned by May Department Store Co. (May) (defendant). Janelle Cox (plaintiff) was injured when her jacket got stuck under the moving handrail of an escalator in Robinson’s, causing her to be thrown down and dragged to the top of the escalator. There was nothing unusual about the escalator’s operation, Cox’s jacket, or the way Cox was riding the escalator. Cox sued May for negligence based on a theory of res ipsa loquitur. The trial judge granted May’s motion for summary judgment.
